The terms “YOU,” “YOUR” or “USER(S)” refers to any individual accessing the Site for his/her/its own personal purposes or behalf of other person, for purposes related to taking classes, workshops, or any other type of instruction or mentorship. In the event that you purport to be the agent of, represent, or otherwise act on behalf of an entity or any other person, references to “you,” “your” or “User(s)” shall include you individually and any such person that you purport to represent, and you further represent and warrant that you are in fact an authorized representative of such person, that you have the authority to the person to this Agreement, and that your acceptance of this Agreement shall constitute acceptance on behalf of such person.
IF YOU ARE UNDER THE AGE OF 13, YOU MAY NOT CREATE OR REGISTER AN ACCOUNT FOR THE SITE WITHOUT CONSENT AND APPROVAL FROM YOUR LEGAL PARENT OR GUARDIAN. IF YOU ARE A PARENT OR GUARDIAN AND YOU PROVIDE CONSENT FOR YOUR CHILD UNDER THE AGE OF 13 TO REGISTER WITH THE SITE, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS IN RESPECT OF SUCH CHILD'S USE OF THE SITE.
We reserve the right to withdraw or amend the Site, and any service or material we provide on the Site, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Site is unavailable at any time or for any period.

We reserve the right, at our discretion, to change, modify, add, or remove portions of the Terms and Conditions at any time. Please check the Terms and any Guidelines periodically for changes that are made after you open your account. Your continued use of the Site after the posting of changes constitutes your binding acceptance of such changes.
By using the Site and providing your phone number and/or email, you agree and acknowledge that Company may communicate with you via email, text messaging, text receipts, Short Messaging Service (“SMS”), facsimile, and all phone calls at the number you provide. Such communications may be for any purpose, including marketing purposes

You may use the Site only for lawful purposes and in accordance with these Terms and Conditions. You agree not to use the Site:
- In any way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries).
- For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information, or otherwise.
- To send, knowingly receive, upload, download, use, or re-use any material that does not comply with the Content Standards set out in these Terms and Conditions.

- Take any action with respect to any User Contribution that we deem necessary or appropriate in our sole discretion, including if we believe that such User Contribution violates the Terms and Conditions, including the Content Standards, infringes any intellectual property right or other right of any person or entity, threatens the personal safety of users of the Site or the public, or could create liability for the Company.
- Disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, including their intellectual property rights or their right to privacy.

Without limiting the foregoing, we have the right to cooperate fully with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information of anyone posting any materials on or through the Site. YOU WAIVE AND HOLD HARMLESS THE COMPANY AND ITS SERVICE PROVIDERS FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY THE COMPANY DURING, OR TAKEN AS A CONSEQUENCE OF, INVESTIGATIONS BY EITHER THE COMPANY OR LAW ENFORCEMENT AUTHORITIES.
However, we do not undertake to review material before it is posted on the Site, and cannot ensure prompt removal of objectionable material after it has been posted. Accordingly, we assume no liability for any action or inaction regarding transmissions, communications, or content provided by any user or third party. We have no liability or responsibility to anyone for performance or nonperformance of the activities described in this section.
The Site allows you to post, comment, discuss, learn, and connect with other users who share your passion, interests, or goals. Together we form a community, and as a community we encourage support. These content standards establish that all users are treated with respect and each such user’s privacy and safety are our priority.
These content standards apply to any and all user interaction with instructors, user interaction with other users, User Contributions and use of Interactive Services (“USER CONTENT”). (2) License Grant to Other Curious Cardinals Users: By posting, submitting or distributing User Content through the Site, you hereby grant to each user of Curious Cardinal a non-exclusive license to access and use your User Postings in any manner permitted or made available by Curious Cardinal on or through the Site.
If you believe that any User Contributions violate your copyright, please see our Copyright Policy for instructions on sending us a notice of copyright infringement. It is the policy of the Company to terminate the user accounts of repeat infringers.
The information presented on or through the Site is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Site, or by anyone who may be informed of any of its contents.
This Site may include content provided by third parties, including materials provided by other users, bloggers, and third-party licensors, syndicators, aggregators, and/or reporting services. All statements and/or opinions expressed in these materials, and all articles and responses to questions and other content, other than the content provided by the Company, are solely the opinions and the responsibility of the person or entity providing those materials. These materials do not necessarily reflect the opinion of the Company. We are not responsible, or liable to you or any third party, for the content or accuracy of any materials provided by any third parties.
We may update the content on this Site from time to time, but its content is not necessarily complete or up-to-date. Any of the material on the Site may be out of date at any given time, and we are under no obligation to update such material.
Each course, workshop, or service has its own cost. You are responsible to the Company for any payment applicable to the course, workshop, or service. You authorize Company or its designated payment processor to charge your specified credit card, debit card, or other payment method for such payment as provided through enrollment.
Unless otherwise specified, all payments are to be made in United States dollars, and all charges will be made in United States dollars. Any applicable sales or other taxes are additional to the stated fee. Currency exchange settlements and foreign transaction fees are based on your agreement with your credit card or other payment method provider.
Payment from you shall be dealt with as follows:
- You agree to pay the Company the agreed upon package or hourly rate ($95/hr unless otherwise agreed upon in writing) for any and all tutoring, mentorship, and workshop services.
- You understand that you will be charged bimonthly.
- If your invoice is not paid within the 7 day billing period, you may be subject to a $100 surcharge.
- All payment processing services are provided by our payment processor, Stripe, and are subject to the Stripe’s Terms of Service. By entering into this Agreement, you agree to be bound by Stripe’s Terms of Service As a condition of Curious Cardinals enabling payment processing services through Stripe, you agree to provide Curious Cardinals with accurate and complete information about You (or a person you are acting on behalf of) and you authorize us to share information related to your payment as processed by Stripe.
- Except as required by law, all payments are nonrefundable.
- Payments and purchases may not be canceled by the user, except as required by law.
- Company (or its partners) reserves the right to refuse or terminate any purchase or attempted purchase at any time in its sole discretion.
You understand and agree that if you authorize a payment transaction with your credit card, debit card, or other payment method, but your charge is rejected for any reason, there may be a hold on your use of that transaction amount for several days.
The customer agrees to enter the subscription agreement with Curious Cardinals Inc will have an accepted payment method on file to be charged the subscription amount on a monthly cadence from the date of purchase in exchange for Curious Cardinals services. Any additional charges incurred by the customer will be charged to the customer’s payment method on file on the 1st and 16th days of the month.
The customer has the right to cancel their subscription during the service evaluation period which begins on the date of purchase and ends 14 days after. The customer can cancel anytime in the application or by notifying a Curious Cardinals customer service employee in writing. Upon cancellation, the customer will not be charged the subscription fee at the end of the evaluation period. The customer will no longer receive services from Curious Cardinals for the engagement of the canceled subscription.
The customer is obligated to a 2 month minimum subscription period. The customer will not be able to cancel their subscription during this period and is obligated to pay for any charges incurred.Rematches are acceptable and any remaining credits on the subscription may be transferred to the new engagement created from the rematch.
You understand that we cannot and do not guarantee or warrant that files available for downloading from the internet or the Site will be free of viruses or other destructive code. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for anti-virus protection and accuracy of data input and output, and for maintaining a means external to our site for any reconstruction of any lost data.
To the maximum extent allowed by law, the Site and its content are provided “as is” and “as available,” and at your sole risk.TO THE FULLEST EXTENT PROVIDED BY LAW, WE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY A DISTRIBUTED DENIAL-OF-SERVICE ATTACK, VIRUSES, OR OTHER TECHNOLOGICALLY HARMFUL MATERIAL THAT MAY INFECT YOUR COMPUTER EQUIPMENT, COMPUTER PROGRAMS, DATA, OR OTHER PROPRIETARY MATERIAL DUE TO YOUR USE OF THE SITE OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE OR TO YOUR DOWNLOADING OF ANY MATERIAL POSTED ON IT, OR ON ANY SITE LINKED TO IT.

Any legal suit, action, or proceeding arising out of, or related to, these Terms and Conditions or the Site shall be instituted exclusively in the federal courts of the United States or the courts of the State of California, in each case located in the City of Los Angeles and County of Los Angeles. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
At Company's sole discretion, it may require you to submit any disputes arising from these Terms and Conditions or use of the Site, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying California state law.
ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS AND CONDITIONS OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

If any provision of these Terms and Conditions is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms and Conditions will continue in full force and effect.
